New England Greens, LLC (“Vibrant Health”) respects the privacy needs and concerns of our customers. This Privacy Policy describes the Personal Information we gather about you, what we do with it, the safeguards we have in place to protect it, and how you can control our use of it. By using the Website, the user agrees, without limitation or qualification, to be bound by this Privacy Policy.

When you provide Personal Information on our Website, you are consenting to the manner in which Vibrant Health will collect, use, disclose and otherwise manage your Personal Information, as set out below. If you do not agree to the collection or use and disclosure of your information or personal information from your use of the Website as described in this Privacy Policy, you may not use this Website. By accepting the Vibrant Health Account Agreement, you confirm that you have read and understand this Privacy Policy and you acknowledge that we will store, use, and otherwise process your information.

Who May Use the Website
The Website is not intended or designed to attract users under the age of 18. No one under age 18 may provide any Personal Information to or on the Website. We do not knowingly collect Personal Information from children under 18. If you are under 18, do not use or provide any information on this Website or through any of its features, register on the Website, make any purchases through the Website, use any of the interactive or public comment features of this Website, or provide any information about yourself to us, including your name, address, telephone number, email address, or any screen name or user name you may use. If we learn we have collected or received Personal Information from a child under 18 without verification of parental consent, we will delete that information. The Website is intended for users from the United States and those not governed by privacy policies of other countries. Users from the European Union are advised not to disclose Personal Information to Vibrant Health. Information sent to us will be housed on servers located in the state of Connecticut in the United States. By providing your Personal Information, you consent to the application of US law and to the use and disclosure of your information consistent with this Privacy Policy.

Personal Information
We may collect Personal Information that you provide us to improve our website, enhance your web experience and for marketing and promotional purposes. When you call our Call Center about a product, delivery, billing question or for customer service, you may be asked for Personal Information that identifies you along with additional information we need to help us promptly answer your question, such as your name, address, and phone number for us to contact you. We may retain this information to assist you in the future.

When you ask a question, participate in a survey or enter a contest or sweepstakes through our Website, we may collect your name, address, phone number and e-mail address.

If your purchases are being shipped to you, your shipping information will be shared with our delivery service providers (U.S. Postal Service, UPS, or other delivery companies we or you select). Our delivery service providers are asked not to use your Personal Information for any purpose other than making the delivery.

When you return previously purchased merchandise or request a refund or exchange, you may be asked to provide Personal Information to help prevent fraud.

Registration is an optional service provided by our Website. You do not have to register to browse on our Website, but you do have to register to purchase products on our Website. When you register, you are asked for Personal Information which may be used to help make your online shopping faster and easier.

When you purchase products from our site we will collect your credit or debit card information and keep a history of your purchases. Vibrant Health provides these links to you as a convenient method of accessing information that may be useful or of interest to you. Vibrant Health does not endorse any of the products or services marketed at these other sites. We are not responsible for the content, accuracy, or opinions expressed on any third party. We will not, and are under no obligation to, investigate, monitor or check third party sites for accuracy or completeness, or for any obscene, scandalous, inflammatory, pornographic, indecent, profane, defamatory or unlawful content or materials. You understand and agree that by clicking on a link to a third party site you have left this Site, and the Vibrant Health Privacy Policy stated on this Site is no longer in effect.

We may share your Personal Information with business partners who offer services in conjunction with those of Vibrant Health and who we believe may provide offers that may be of interest to you. As described above, you may limit this sharing by following the instructions in the Opt-Out Section below.


We may also disclose your Personal Information:

To comply with any court order, law, or legal process, including to respond to any government or regulatory request.
To enforce or apply our Account Agreement and Auto-Delivery Terms and Conditions and other agreements, including for billing and collection purposes.
If we believe disclosure is necessary or appropriate to protect the rights, property, or safety of Vibrant Health, our customers, or others. This includes exchanging information with other companies and organizations for the purposes of fraud protection and credit risk reduction.


Opt-Out
Individuals whose Personal Information is covered by this Privacy Policy have the right to access the personal information that Vibrant Health maintains about them as specified in this Privacy Policy. Individuals may contact us to correct, amend or delete such personal information if it is inaccurate or has been processed in violation of this Privacy Policy (except when the burden or expense of providing access, correction, amendment, or deletion would be disproportionate to the risks to the individual’s privacy, or where the rights of persons other than the individual would be violated). You may choose to have your name taken off of our registration list, cease receiving correspondence or newsletters from us, or you can update or delete the Personal Information that you have provided to us, via one of the following methods:

Nevada residents who wish to exercise their sale opt-out rights under Nevada Revised Statutes Chapter 603A may submit a request to this designated address: mail@vibranthealth.com. However, please know we do not currently sell data triggering that statute’s opt-out requirements.

Unless otherwise noted, the e-mail on the Website does not provide a completely secure and confidential means of communication. It is possible that your e-mail communication may be accessed or viewed by another Internet user while in transit to us. If you wish to keep your information private, you should not use our e-mail, contacting use through the appropriate customer service telephone number

Your California Privacy Rights (California Residents)
The Cal. Civ. Code §1798.135 (California Consumer Privacy Act) requires companies to include certain disclosures including on their websites regarding the types of information collected and shared and the third parties with whom such information may be shared or provide the resident with an option to Opt-Out of having their information shared with third parties. This Privacy Policy describes the information collected and with whom it may be shared. In addition, Vibrant Health provides California residents the option to Opt-Out of such sharing of information in the Opt-Out section.

California Do Not Track Disclosures
No action is taken in response to web browser “do not track” signals or other mechanisms that provide consumers the ability to exercise choice regarding the collection of personally identifiable information about an individual consumer’s online activities over time and across third-party web sites or online services. Although we use Google Analytics and other third party tracking tools for the Site, we are not aware if third parties collect personally identifiable information about an individual consumer’s online activities when a consumer uses the Site.
